Terms of Service

Welcome to PaceStep: Simple Step Counter (the “App”), owned and operated by PaceStep (“we”, “our” or “us”). By downloading, installing or using the App, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App. Our Privacy Policy explains how we handle your information.

1. Who can use the App

You must be at least 13 years old (16 in the European Economic Area) to use the App. By using it, you confirm that you meet this requirement and are able to enter into these Terms.

2. Health and medical disclaimer

PaceStep is designed for general fitness and wellness only. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or condition.

  • Not medical advice. Step counts, distance, calories, active time and BMI shown in the App are estimates. They are not medical, nutritional or clinical advice.
  • Talk to a professional. Speak with a doctor or qualified health professional before starting a new exercise routine, especially if you have a health condition.
  • Your own risk. Walking and exercise carry some risk. You use the App and take part in any activity at your own risk.

3. Accuracy of step counting

  • The App counts steps using your phone's built-in motion and step sensors.
  • Accuracy can vary with your device, where you carry it (pocket, bag, hand), walking speed, terrain and how your phone saves battery. Some phones may pause background counting to save power.
  • We do not promise that step counting will be exact or uninterrupted on every device.

4. Your profile and leaderboard

  • You agree to provide information that is accurate to the best of your knowledge.
  • The leaderboard shows your name and step total to other users. Please do not use a name that is offensive, misleading or that impersonates someone else. We may remove or change a name that breaks this rule.
  • Do not try to cheat the leaderboard, for example by shaking the phone or using tools that fake steps. We may remove such entries.

5. Deleting your account

You can delete your account at any time in the App under Settings → Delete Account & Data. This permanently deletes your profile and all recorded step activity from our database and cannot be undone.

6. Licence and acceptable use

We give you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the App on Android devices you own or control, for non-commercial purposes. You agree not to:

  • copy, modify or create derivative works of the App;
  • reverse engineer, decompile or try to extract the source code of the App;
  • sell, rent, lease, sublicense or otherwise commercially exploit the App;
  • interfere with the App, our servers or other users, or try to gain unauthorised access to them;
  • use the App in any way that breaks the law.

7. Intellectual property

The App, including its code, design, graphics, icons, logos and content, belongs to PaceStep and its licensors and is protected by intellectual property laws. These Terms do not give you any ownership of it.

8. Advertising, crash reporting and paid features

The App does not currently show advertisements or charge for features. We plan to add crash reporting and may add advertising in the future, and we may introduce paid options. If we do, we will update our Privacy Policy and, where needed, these Terms. Any payments would be handled through Google Play and follow Google Play's terms and refund policies.

9. No warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT ALLOWED BY LAW. WE DO NOT PROMISE THAT THE APP WILL MEET YOUR HEALTH OR FITNESS NEEDS, THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ITS MEASUREMENTS WILL BE EXACT.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, PACESTEP AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, LOSS OF DATA OR DEVICE DAMAGE, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PRECEDING TWELVE (12) MONTHS, OR USD $50, WHICHEVER IS LESS. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED UNDER THE LAW WHERE YOU LIVE.

11. Indemnity

You agree to defend and hold PaceStep harmless from claims, losses and expenses (including reasonable legal fees) that arise from your breach of these Terms or your misuse of the App, to the extent allowed by law.

12. Ending your use

You can stop using the App at any time by deleting your account and uninstalling it. We may change, suspend or stop the App, or restrict your access if you break these Terms.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Continuing to use the App after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the country in which PaceStep is established, without regard to conflict-of-law rules. If you are a consumer, you also keep any mandatory rights you have under the laws of the place where you live.

15. General

If any part of these Terms is found to be unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and PaceStep about the App.
